Dietary Supplement Safety Act of 2010 (DSSA)
Currently called S.3002

This bill by Senators John McCain and Byron Dorgan simply infringes on each American's individual right to choose the kind of healthcare they wish to use. It will cause the end of hundreds of thousands of jobs in the natural health industry, as well as make it nearly impossible for Americans to purchase their natural, food-grade supplements at reasonable prices and in existing potencies. This bill is just one more measure the government is using to squelch creativity and innovative entrepreneurism in America.
 
McCain and Dorgan are using the unpopular, government contrived 
controversy surrounding the use of steroids by athletes to further implant government control into our lives and giving the FDA more control; never mind the fact that these athletes were "juiced" by their own team doctors or sport doctors and that this has nothing to do with the supplement makers or health food stores the rest of us use! In the past 50 years, deaths from supplement use have been relatively low (less than 5 deaths per year) and has only occurred when taken specifically against the recommended label dosage (for instance, eating no food and taking ephedra in massive doses to lose weight rapidly to fit into a wedding dress) OR when taken in conjunction with the enhanced side-effects of a prescription drug.

Further, the Food and Drug Administration has yet to protect the American public from the harmful side-effects and over 100,000 deaths caused each year by the pharmaceutical companies, from prescriptions used AS INTENDED

The existing DSHEA bill passed in 1994 already provides protection to Americans, with regard to natural food vitamins, minerals, herbs and supplements, without the invasive government intervention in natural healthcare choices.

Under DSHEA, both the FTC and the FDA have adequate legal authority to remove supplements that contain illegal drugs from the market. To the contrary, McCain's
Dietary Supplement Safety Act of 2010 gives the FDA broad power to remove natural products from the marketplace without any review or due process. This is not the process for removing prescription medications from the market, so why is this fair for the natural products industry? Could it be because many in Congress and the FDA are funded by pharmaceutical lobbyists? This bill is corrupt; it will enable the pharmaceutical industry to dictate to your representatives and the FDA which natural ingredients shall be removed from the natural products industry so that they (the drug companies) can confiscate these known effective natural ingredients, then synthetically remanufacture them for their own use in expensive prescription drugs (complete with harmful side-effects). Just last year, Vitamin B6 (pyridoxamine) was removed from the natural products industry's use because a drug company wants to use B6 in a new prescription drug.

If McCain's bill is passed, pharmaceutical companies will have natural remedies pulled from the natural products market to use in patents for their drugs. "Supplements" will no longer be what you know and love; pricing will increase multi-fold and will only be available by prescription after seeing your medical doctor. Such is the way it is throughout Europe, as the Europeans either failed to pay attention to yet another choice being taken from them, or did not care at the time. Currently, people from all over the world, who relinquished their sovereignty to the World Health Organization (WHO) beg American retail health food stores to ship to them overseas; further, it is ILLEGAL in Europe to grow your own wild oregano, echinachea or even peppermint, because they are used medicinally! AMERICA, THE LAST BASTION OF FREEDOM, IS NEXT! Will YOU let this happen to you and your country?

The National Health Federation – A not-for-profit Health-Freedom Organization

They are at it again!  This time, it is Senator John McCain (R-AZ) and Senator Byron Dorgan (D-ND) who are trying to gut the Dietary Supplement Health and Education Act of 1994 by introducing a new bill (as yet unnumbered) with the misleading title of the "Dietary Supplement Safety Act of 2010."  This bill has as much to do with safety as pigs with space travel.

Senator McCain just held a press conference to announce that he was co-sponsoring his Dietary Supplement Safety Act of 2010 with Senator Dorgan. The bill will be introduced shortly in the Senate.

As Scott Tips, the president of the National Health Federation, stated, "This bill strikes at the heart of the Dietary Supplement Health and Education Act (DSHEA), which was passed unanimously by the U.S. in 1994, and which took away the Food and Drug Administration's arbitrary powers over supplements.  Now, this bill would create a Euro-style 'positive list' of 'acceptable' new dietary ingredients.  And by 'acceptable,' the bill means acceptable to an appointed bureaucrat.  This is completely unacceptable.  Failure to comply would result in punitive fines upon such a company selling or distributing a product not being 'accepted.'"

"Just as bad," Mr. Tips continued, "would be the proposed change in the definition of an adverse event to be reported to the FDA concerning any supplement.  As we first predicted when the AER bill was introduced (and unfortunately supported by too-many dietary supplement companies), this adverse event reporting bill was only to be the camel's nose in the tent.  More would follow, NHF predicted. And this new bill proves that we were right.  McCain and Dorgan want to change the events to be reported from 'serious adverse' events to any 'adverse' events!  This is totally unacceptable since supplements already have the safest track record of any consumable on the planet.  It is just once again politicians using a special-interest group to advance their own pro-pharmaceutical agenda against natural health products."

These two Senators want to make a law based on NFL players who took weight loss supplements.  Supplements have other healthy benefits, and access of millions of consumers of dietary supplements should prevail over six highly paid football players, who cannot read the labels on supplement products."

The reason put forth by Senator McCain for his advancing this bill was that the government needed to protect athletes who are often surprised by positive drug tests, believing that the supplements they are taking are safe, legal, and free of banned substances.  He declared that all Americans have a right to know what ingredients are in the supplements they use, and that FDA should have the authority to regulate the safety of dietary supplements.

This is complete nonsense.  You don't take a hammer such as this and destroy a safe industry just to help a few consumers, who have clear-cut alternatives anyway.  As they already do today, athletes can share information about which companies make which products that are safe for them to take so as to pass drug tests.  A sane person does not destroy an entire industry for reasons such as this one.

We urge everyone to join with the National Health Federation in killing this bill before it even takes its first breath.  Telephone Senators McCain's and Dorgan's offices to tell them in no uncertain terms how strongly you are opposed to their ridiculous, power-grabbing bill.  Then, send them an e-mail saying the same.  Then write them a letter telling them exactly what you think of them and where they can shove this bill.  Be polite, but be persistent and vocal.  Be sure to write and telephone both of your Senators to register the same complaint.
